WRC says Bahman Honari’s discrimination complaint against HSE office was out of time

The Workplace Relations Commission found Bahman Honari’s complaint against the Healthcare Pricing Office, HSE, was out of time and that it had no jurisdiction to hear it. The decision was dated 20 November 2023; the merits were not decided. Honari alleged age and race discrimination during a recruitment interview and process in July 2022. He argued the relevant date was 23 August 2022, when he received the outcome of an appeal within the recruitment process. The HSE said the interview date started the six-month referral period. The adjudicator found no evidence of a discriminatory act within the period the law allowed for bringing the complaint, or of a continuing act that would bring it within time. An internal appeal did not stop the statutory time limit from running.
