WRC rejects childcare worker’s unfair-dismissal complaint

The Workplace Relations Commission found that Emma Daly was not unfairly dismissed after resigning from Dolphins Early Education And Childcare Centre and trying to withdraw her resignation. The decision, dated 15 July 2024, said the employer’s conduct did not cause her resignation and she had not shown special circumstances allowing her to retract it. Daly had raised concerns about working with a more senior room leader and said she tried to bring the issues to management. She resigned in November 2022, with the resignation taking effect in December. The adjudication officer found her frustration did not amount to constructive dismissal and that the employer was entitled to treat the resignation as final.
