The Workplace Relations Commission directed Cleandata Limited to pay Anoushka Anilkumar Parmar €10,500 in unpaid wages and €2,500 for constructive dismissal. The decision, dated 15 July 2024, found that the company had failed to pay wages properly due and breached a core term of her employment contract. Her Employment Equality complaint was not well founded.

Parmar worked for Cleandata from November 2020 until resigning in June 2022. She told the WRC that her salary had effectively stopped in January 2022 and that €10,500 remained unpaid. The adjudication officer found the wages were properly payable and that no lawful deduction had been established. The failure to pay entitled Parmar to treat herself as dismissed.

The company did not attend the hearing. The officer extended the six-month time limit, finding that the prospect of rehire and Parmar’s visa circumstances explained and excused the delay in filing. Parmar found another job almost immediately, so the officer said she had no financial loss from the dismissal and awarded four weeks’ wages, €2,500. The equality complaint was not pursued at the hearing, and no evidence of prohibited conduct was presented.
