The Workplace Relations Commission awarded Alexandru Sirbu €1,732 after finding that Derby Transport Limited ended his employment without notice. The decision, dated 24 November 2023, also found his victimisation complaint not well founded. Sirbu said he was dismissed after bringing an earlier WRC complaint and was not paid his notice entitlement. Derby Transport disputed his account, saying he had resigned. The adjudication officer accepted Sirbu’s account on notice after two employees said to have witnessed the alleged resignation did not attend to give evidence. The officer rejected the victimisation claim, finding Sirbu had not established that he had taken a protected act under employment equality law. He withdrew his working-time and unfair-dismissal complaints at the hearing. The upheld minimum-notice claim concerned two weeks’ pay; his average net weekly pay was €866.
