WRC rejects Declan Mc Aleer’s redundancy appeal after finding service transferred

The Workplace Relations Commission did not uphold Declan McAteer’s appeal for statutory redundancy in a decision dated 28 February 2024. It found his employment and service transferred to a successor operator, so he was not dismissed on redundancy grounds by Ajpc Retail Limited T/A Costcutter(in liquidation). McAteer said he was dismissed in January 2023 and sought redundancy based on service dating from 2016. The former employer argued the successor operator was responsible for any payment. The WRC found the same business reopened under the new operator without a break in service; his earlier service formed part of the transfer.
