WRC does not uphold Emma Martin’s redundancy appeal

Place: no local area assigned from the source.

The Workplace Relations Commission did not uphold Emma Martin’s appeal against Ajpc Retail Limited T/A Costcutter (now in liquidation) refusing to pay statutory redundancy. The officer found Martin’s employment transferred with the business to a successor employer, so she was not dismissed on redundancy grounds by Ajpc Retail. Adjudication officer Janet Hughes dated the decision 29 February 2024. Martin sought redundancy based on her full service. Staff had been told to expect to work until the end of January, but the premises’ locks were changed on 16 January and they could not return. Hughes found the same core business reopened at the site under A and employees’ service transferred without a break. She concluded Ajpc Retail had no liability to pay Martin redundancy.
