WRC rejects Melissa Sanders’ disability discrimination complaint against Neutrapharma

The Workplace Relations Commission found that Neutrapharma did not discriminate against Melissa Sanders after dismissing her from a sales and marketing role. The decision, dated 9 January 2024, concerned her claim that spelling difficulties linked to ADHD contributed to her dismissal.

Sanders said she was dismissed because of persistent spelling errors connected to ADHD. Neutrapharma said she struggled with the role and cited performance and meeting concerns. The adjudicator accepted that ADHD met the legal definition of a disability and found that spelling was identified as a reason for extending her probation.

The WRC found that the company had rebutted the inference of discrimination. It had proofread Sanders’s work and bought Hootsuite to help with spelling; Sanders told the adjudicator the company had done as much as it could to help. The complaint was found not well founded, so no compensation was awarded.
