The Workplace Relations Commission found that Melissa Daly was not discriminated against on gender or family-status grounds by Life Style Sports Ltd. In a decision dated 5 April 2024, it also found her complaint about her employment terms not well founded. Daly argued that past sick-pay practices had become part of her contract and said she was treated less favourably than a male colleague. Life Style Sports said sick pay was discretionary and that its policy was applied equally. The Commission found that Daly’s contract provided no sick-pay entitlement, the company had not changed her employment terms, and there was no evidence that she was treated because of her gender or family status. It noted the company had agreed to repay three sick days deducted in November 2022.
