The Workplace Relations Commission awarded Jeroen Proos €101,000 after finding that Human + Kind Limited unfairly dismissed him. The decision was dated 26 April 2024.
Proos, a former executive, said the company dismissed him without warning, a process or a right of appeal, and without discussing redundancy. The company was in liquidation and did not attend the hearing; its written allegations about his performance were not tested by witnesses.
The adjudication officer accepted Proos’s evidence that he was dismissed without reason or procedures. The officer said Proos made reasonable efforts to limit his losses, including setting up his own business, and capped prospective losses at 12 months when setting compensation.
