The Workplace Relations Commission found Kieran Keoghan was unfairly dismissed by Linlathen Limited Ltd, trading as Harris Windows, and directed €4,800 in compensation. The decision was dated 5 September 2024.
Keoghan worked as a fitter and was dismissed after an incident in which a window fell on a colleague’s foot. The company said his conduct toward customers and colleagues led to the dismissal. Keoghan said he was dismissed without fair procedures, including an investigation or notice that a meeting could lead to dismissal.
The adjudicator found conflicting evidence about the incident and said a proper investigation would have given those involved the right to be heard. The decision found there was no fair investigation or due process and that the dismissal was unfair. It selected compensation, taking account of Keoghan’s contribution to the situation and scant evidence of attempts to reduce his loss. His separate minimum-notice complaint was withdrawn at the hearing.
