A Workplace Relations Commission adjudication officer found shop worker Damien Kearns entitled to statutory redundancy payment and ordered his employer, Phillip Kane t/a Kane's Yourstop, to pay €1,815 for minimum notice. The decision was dated 2 October 2023. Kearns had worked as a retail assistant from May 2008 until the shop closed in December 2022. Kane argued that the former owners, who were in liquidation, should be responsible for the redundancy payment. The officer found Kane was Kearns’s employer because he provided his contract, paid his wages and arranged statutory deductions. Kearns received one week’s notice but was entitled to six weeks.
