The Workplace Relations Commission found that the Commissioner of An Garda Síochána discriminated against Joseph Joyce by returning him to workplace duties in early 2022 without an individual risk assessment or reasonable accommodation. But adjudication officer Penelope McGrath ruled that the complaint was lodged outside the time limit and declined to extend it.
Joyce alleged that the Commissioner discriminated against him on disability grounds, including by failing to accommodate him and treating him less favourably at work. The Commissioner denied discrimination and said workplace safety measures were in place. For the six-month period the WRC could consider, McGrath found no discrimination: Joyce was on sick leave and the procedures he challenged applied to colleagues on sick leave too. The complaint failed and no award was made.
