The Workplace Relations Commission awarded Sylwia Ignacok €2,380.87 after finding that Caspian B.M.P Limited Caremark Galway failed to pay her for three days’ work and did not provide adequate breaks or Sunday compensation. The WRC decision was dated 24 May 2024.
Ignacok worked as a health-care assistant, travelling between clients’ homes from May to August 2022. She complained of underpayment, unpaid Sunday premium, inadequate rest and breaks, excessive weekly hours and unpaid final wages. The employer disputed her working-time calculations, citing appointment schedules and gaps between visits.
The adjudication officer found that travel between client homes, when scheduled by the employer, counted as working time. The minimum-wage complaint and claims about daily rest, weekly hours and annual leave were not well founded. Ignacok was awarded €1,008 for Sunday work and €1,008 for inadequate breaks; the officer found the employer had not kept sufficient break records.
The officer also directed the employer to pay €364.87 for unpaid wages, less any lawful deductions. The separate €250 accommodation deposit was outside the Payment of Wages Act because it was not wages.
