The Workplace Relations Commission (WRC) ruled on 17 January 2024 that it had no jurisdiction to hear John Feeney’s discrimination and harassment claims against Lismore Golf Club because he had named the wrong employer. The merits were not decided. Feeney worked under a community employment scheme at the club. His employment contract identified Lismore Community Development CLG as his employer, and the WRC found his request to substitute the employer came outside the time limit. The WRC found the misnaming was inadvertent and that the proposed respondent would not suffer injustice. It granted leave for fresh proceedings against Lismore Community Employment Scheme CLG.
WRC allows John Feeney to bring fresh proceedings against proposed employer
