The Workplace Relations Commission ordered Emex Software Limited to pay Talita Di Cavallotti €3,466 after finding the company unlawfully withheld her final salary and accrued leave. The decision was dated 5 June 2024.

Di Cavallotti said the company failed to pay what she was owed after she resigned. She presented a payslip and a letter showing the amount due. The company did not attend the hearing, but the adjudication officer was satisfied it had notice and accepted her evidence that the payment had not been made.

The officer found the non-payment was an unlawful deduction from wages under the Payment of Wages Act 1991. The order requires the company to pay €3,466; the decision does not specify whether the award is gross or net.
