The Workplace Relations Commission awarded Kenneth Brennan €1,137.75 after finding his dismissal unfair because of a flawed investigation, although it concluded dismissal was justified on the substance of the case. The decision was dated 19 January 2024. The award was reduced by 75% after the WRC found Brennan had contributed 75% to his dismissal.
Maybin Support Services (Ireland) Ltd Momentum Support said it dismissed Brennan for gross misconduct over inappropriate comments to a colleague. Brennan challenged the investigation and disciplinary process. The WRC found a reasonable employer would have dismissed him for the comments, but found the investigation procedurally flawed. His separate minimum-notice complaint was not well founded.
