The Workplace Relations Commission dismissed Joseph Dunne’s unfair dismissal complaint against An Post because he referred it outside the time limit and did not establish reasonable cause for an extension. The WRC decision was dated 8 September 2023. Dunne worked as a postal operative for An Post before resigning in March 2021. He said he was constructively dismissed after objecting to using delivery tricycles and being refused a return to night work; An Post denied the claim. The WRC found it lacked jurisdiction to consider the complaint because it was filed late and the reasons given did not explain or excuse the delay. The merits of his dismissal complaint were not decided.
