The Workplace Relations Commission found Pawel Wzorek’s complaint against Lily’s Limited trading as Lily O'Brien's Chocolates not well founded. The decision was dated 5 September 2023. Wzorek argued he was owed pay for 6.08 additional days of contractual holiday accrued while he was on sick leave. The company said only statutory annual leave accrued during sick leave and that it had paid all amounts due when his employment ended. The officer found the company’s illness policy formed part of Wzorek’s contract and provided for statutory, not contractual, holiday accrual during sick leave. The officer concluded that all wages properly payable on termination had been paid.
