The Workplace Relations Commission awarded Bhimraj Sumroo €4,650 for unpaid annual leave and compensation equivalent to six months’ wages for unpaid Sunday premiums. It also found he was entitled to a statutory redundancy lump sum, subject to insurable employment, and awarded €3,484.55 gross for minimum notice. The decision was dated 8 June 2023. Sumroo worked as a kitchen supervisor for Moport Ltd Koh Restaurant from 2008 until the restaurant closed in June 2022. He said he was owed annual leave, Sunday compensation and six weeks’ notice pay. The WRC found he had received no Sunday premium during 14 years of Sunday work and no evidence showed he had been given a chance to take his annual leave or warned it would be forfeited. Two complaints were identified as duplicates.
