Lauren Kelly’s complaint against Aviva arose after she was asked to repay a €9,500 overpayment linked to parental leave. The Workplace Relations Commission found the complaint not well founded in a decision dated 12 June 2023.
Kelly said Aviva had approved her weekly parental-leave days after she returned from maternity leave in 2020, but failed to deduct them from her pay. Aviva said parental leave is unpaid and that an administrative error caused the overpayment. The adjudicator found there was no legal obligation to pay wages during parental leave and noted a contract term allowing recovery of money owed.
