The Workplace Relations Commission awarded Aleksandrs Rodjukovs €16,500 after finding he was unfairly dismissed by Cp Naughton Ltd. The decision was dated 8 January 2024.
Rodjukovs said he was hired for a management role but assigned cleaning work, and denied resigning. CP Naughton argued that he resigned, that his fixed-term contract ended, or that he was an agency worker and the company was not the right respondent.
The adjudicator rejected those defences, finding that the fixed-term exemption did not apply because the relevant contracts were not signed by both parties and that the evidence did not establish an agency placement. The adjudicator found that ending Rodjukovs's employment without procedures while he was on sick leave after an accident fell far short of what a reasonable employer would do.
The compensation, equal to six months' gross salary, was awarded for loss arising from the unfair dismissal. Rodjukovs gave evidence about efforts to reduce his losses and found work with a local retailer.
