The Workplace Relations Commission dismissed Monika Pajkert’s appeal for a redundancy payment from Blackwell And Wright Senior Care Limited trading as Home Instead Senior Care, in a decision dated 30 March 2023. The adjudicator found her employment transferred to a new provider and she had not been made redundant. Pajkert said she had to apply for a new job, undergo Garda vetting and accept changed terms after the care contract moved to another provider. Her former employer argued the contract and the 17 staff who served it transferred together. The WRC found the service contract transferred as an economic entity retaining its identity. It concluded Pajkert was not entitled to redundancy pay under the Redundancy Payments Act 1967.
