The Workplace Relations Commission awarded Donal Ruane €20,275.62 in additional redundancy pay from Roadbridge Civil Engineering & Building Contractors Roadbridge Ltd., and upheld his complaint for eight weeks’ wages in lieu of notice. The decision was dated 26 January 2023.
Ruane said he had worked for the company since 18 January 1993 and was transferred to the UK on 27 May 2021. After his employment ended on 28 April 2022, he sought the balance of Irish statutory redundancy entitlement following a UK redundancy payment. The WRC said his Irish entitlement would have been €35,700, leaving a shortfall of €20,275.62 after the UK payment.
The WRC found his evidence about his service in Ireland and the UK credible and persuasive. It relied on provisions that count service abroad and take account of redundancy payments already received. The respondent did not attend the hearing. The WRC also awarded eight weeks’ wages under minimum notice legislation.
