The Workplace Relations Commission rejected Paula Whyte’s equal-pay complaint against the Health Service Executive, finding she had not established a prima facie case of discrimination. The decision was dated 21 November 2023.
Whyte, a Grade 7 employee, sought a Grade 8 upgrade, saying she carried out freedom-of-information and complaint-review duties assigned to higher-graded staff elsewhere in the HSE. The HSE argued that the comparator roles had different responsibilities, including line management.
The adjudicator said the HSE’s pay-setting system lacked structure but found that the roles Whyte cited spanned several grades and levels of responsibility. The decision found she had not established a prima facie case and had not been discriminated against.
