WRC rejects Declan Martin’s dismissal and sick pay complaints against Campbell Catering

The Workplace Relations Commission found that Declan Martin was not unfairly dismissed and that his complaint over sick pay was not well founded, rejecting both complaints against Campbell Catering Limited t/a Aramark Ireland. Martin said he resigned after a workplace dispute and grievance process. The company said it had followed its grievance and sick pay policies. The adjudication officer found Martin had not shown that the company’s conduct justified his resignation. He had used the 20 days of sick leave available under the company policy, and the officer found no legal basis for additional sick pay under the Payment of Wages Act. The WRC decision was dated 21 November 2023.
