The Workplace Relations Commission awarded Sylwester Wojcik €20,000 after finding his dismissal from Boxer Logistics Limited (In Liquidation) substantively and procedurally unfair. The decision, dated 20 April 2023, also ordered the company to pay him €630 for failing to provide one week’s statutory notice.

Wojcik began working for the company in September 2020. While on annual leave on 2 January 2022, he received a phone call telling him his employment was terminated. A letter cited difficult trading conditions. He complained that he had been unfairly dismissed and denied notice.

The company was in liquidation. Its liquidator told the WRC it would not attend the hearing and did not dispute the claims. The adjudicator found the employer had not shown that the dismissal was fair and accepted Wojcik’s uncontested account. The WRC found he had not made sufficient effort to mitigate his loss when calculating compensation.
