The Workplace Relations Commission found that Kieff Bosse’s dismissal by Hendrick Hotel was fair and that his race discrimination complaint was not well founded. Both complaints failed. In a decision dated 10 October 2023, the WRC said the hotel’s dismissal decision was reasonable and its disciplinary process fair. Bosse said he was unfairly dismissed and treated less favourably because of his race, including over access to CCTV. The hotel said it dismissed him for alleged misconduct and gave him opportunities to respond. The adjudicator noted that Bosse did not attend disciplinary meetings, provide requested medical certification or attend a company doctor appointment. The WRC also noted the hotel later offered him the opportunity to view CCTV footage, which he declined. The WRC found no evidence of race discrimination.
