The Workplace Relations Commission found that William Burchell’s disability discrimination complaint against Garrett Advancing Motion was brought outside the time limit and was not well-founded; the merits were not decided. The decision was dated 27 April 2023.
Burchell alleged that the company discriminated against him and failed to provide reasonable accommodation because he could not wear a mask at work. The company argued that the complaint was late and denied discrimination.
The WRC said the latest possible date for filing was 2 February 2022, but it received the complaint on 31 May that year. It therefore found the complaint was out of time.
