The Workplace Relations Commission dismissed Mary O'Donoghue's complaints of discrimination, harassment and failure to provide reasonable accommodation against Clare County Council, finding that the Equal Status Act did not cover the circumstances. Adjudication officer Janet Hughes dated the decision 1 May 2025.
O'Donoghue alleged that the Council replaced concrete blocks at the entrance to land where she had moved her home, restricting access. The Council said the land was its property and the blocks were replaced to prevent further unauthorised access. The WRC found that replacing blocks on Council land did not amount to providing a service, goods or accommodation under the Act, and dismissed the complaints as frivolous. No compensation was awarded.
