WRC awards Philip Fox €4,690 over HAP discrimination complaint

The Workplace Relations Commission awarded Philip Fox €4,690 after finding that Milfort Properties Ltd. engaged in discrimination on the housing assistance ground by failing to accept and process his Housing Assistance Payment (HAP) application. The decision was dated 15 November 2023.

Fox said Limerick County Council had approved him for HAP, but the landlord did not sign the application form. The landlord said he understood from the council that he was not obliged to accept HAP because the lease was nearing its end. The adjudicator found that the landlord had no reasonable defence for failing to process the form.

The WRC also considered a disability-ground complaint, but found it not well founded because Fox had not established a prima facie case on that ground. The €4,690 compensation was for the effects of the housing assistance discrimination, which left him unable to access HAP funds from May to December 2022.
