The WRC recommended that a clinic pay a health care assistant €8,000 after finding her dismissal unfair. The recommendation was dated 15 November 2023.
The worker said her agreed employment terms were not honoured, wages were paid irregularly without payslips, and she was dismissed after raising concerns. The clinic cited performance and conduct issues, but did not attend the hearing.
The officer found that the worker’s assertion of her rights was a factor in the dismissal. The clinic had not put allegations to her or given her an opportunity to respond or obtain representation. Her probation period did not remove its obligation to act fairly.
