The Workplace Relations Commission found Bruno Seigle-murandi’s unfair dismissal complaint against Roche Products (Ireland) Limited not well founded. The decision, dated 1 November 2023, concerned his dismissal in March 2022 after he sent company emails to private external accounts.
Roche said an investigation found that 851 emails had been sent to those accounts, many containing confidential business material. The adjudication officer found the investigation substantially fair and said Seigle-murandi had an opportunity to review the evidence and present a defence.
The officer also found that sending company information to a private account was not itself a protected disclosure. Seigle-murandi continued to refuse instructions to delete the emails and would not say who could access them. The officer considered dismissal reasonable in those circumstances.
