The Workplace Relations Commission found Katie Hayes Kelly’s complaints against Bare Beauty Clinic not well founded. The decision, dated 1 November 2023, concerned allegations of religious harassment, family-status discrimination and discriminatory constructive dismissal. Hayes Kelly worked at the clinic as a beauty therapist from June to November 2021. The clinic denied discrimination and harassment. The adjudication officer found that the religious harassment claim related to events outside the time limit, that the reduction in hours was unrelated to family status, and that an inappropriate interaction about her religious beliefs did not meet the threshold for discriminatory constructive dismissal. A second complaint form was treated as a duplicate of the first, which was amended by the later form. The officer issued a not-well-founded finding under each complaint reference.
