The Workplace Relations Commission rejected David Ryan’s unfair dismissal complaint against Amazon Data Services Ireland Limited, finding the company’s decision to dismiss him for gross misconduct reasonable. The decision was dated 26 March 2024.
Ryan said the investigation and disciplinary process were unfair. Amazon said it had dismissed him after an investigation into outside business activities, disclosure of confidential information and promoting PM Group while concealing a conflict of interest.
The adjudicator found that Ryan had disclosed information about a rival product to PM Group and concealed that disclosure by blind copying a company executive. She found that a reasonable employer would not tolerate this conduct and that the dismissal process was fair.
His complaints about daily and weekly rest, breaks and excessive hours were rejected because they were outside the time limit. The merits were not decided. Claims concerning holiday pay and minimum notice also failed. Two other complaints, about employment information and working time, were withdrawn at the hearing.
