The Workplace Relations Commission found Aoife O'Reilly was not unfairly dismissed by Laya Healthcare Limited in a decision dated 2 August 2024. O'Reilly said the company’s handling of a third-party complaint and investigation left her no choice but to resign; the company said it was investigating and had not imposed a sanction. The adjudicator criticised flaws in the investigation but found that the company’s conduct before disciplinary proceedings began had not objectively forced O'Reilly to end her employment. She resigned on the same day she raised formal grievances, before the company had time to investigate them. A duplicate unfair-dismissal complaint was withdrawn at the hearing.
