The Workplace Relations Commission found Yassine Imejjat was unfairly dismissed by Kennedy Security and Consultancy Limited and awarded him €2,790. The decision was dated 13-10-22.
Imejjat worked as a security officer assigned to a hospital. The company said it dismissed him after reports that he left the site without permission and left a patient unattended while taking a break. He said the dismissal followed his referral of earlier workplace complaints to the WRC.
The adjudicator found the disciplinary process was flawed, including because it relied on a previous charge that had not been investigated and the dismissal decision was delivered in a contradictory way. The decision said the dismissal was not a reasonable sanction in the circumstances. The award was equivalent to ten weeks’ pay; the adjudicator also noted that Imejjat remained unemployed and had made limited efforts to find other work.
