The Workplace Relations Commission found Darek Targosz was fairly dismissed by Kyte Powertech Limited for gross misconduct and rejected his unfair dismissal and minimum notice complaints. The decision was dated 13-10-22. Targosz, a general operative employed since 2006, left work early without permission and asked a colleague to clock him out later using his fob. He argued that dismissal was disproportionate, citing his work record, his admission of wrongdoing and the more lenient treatment of another employee. The WRC found his conduct was gross misconduct and dismissal fell within a reasonable range of responses. It also found that he was not entitled to statutory notice or pay in lieu because he was fairly dismissed for gross misconduct.
