The Workplace Relations Commission found that security officer Ogungbemi Omojola Dada David Yewande had not established claims of harassment, victimisation or constructive discriminatory dismissal against G4S Secure Solutions. The decision was dated 12 December 2023.
Yewande alleged discrimination on gender, civil status and race grounds. He said he was removed from a clinic post after an encounter with a patient and his wife, and described earlier workplace incidents, including an alleged racist comment. G4S said the client asked for his removal and that it offered him other work, which he refused.
The officer found that Yewande had not linked the alleged harassment incidents to a discriminatory ground in his reports or evidence. He had not complained of discrimination to G4S before taking his case to the WRC, so the officer found the treatment could not have been retaliation for such a complaint. The officer also found that Yewande had access to alternative work and could have pursued a grievance; his departure was not linked to a discriminatory ground. The WRC found no prima facie case, meaning the evidence did not establish an initial case of discrimination requiring a response.
