The Workplace Relations Commission (WRC) found a Payment of Wages complaint by Predrag Grubisa was not well founded after deciding he was not an employee of Ina's Kitchen Desserts Limited (t/a Brodericks). The decision was dated 10 February 2023. Grubisa said he signed and returned an employment contract after being offered a job and had begun moving his family to Ireland. He said the offer was withdrawn on 4 October 2021 after the company changed ownership. The company said the previous management had hired him during a business transition despite a request to pause recruitment. The new owners asked for the contract to be terminated to streamline and support the business. The complaint sought pay in lieu of notice under the Payment of Wages Act 1991. The adjudicator concluded that, because Grubisa was not an employee of the company, there was no breach of the Act.
