WRC awards Rhona Matthews €600 over unlawful public holiday pay practice

The WRC awarded Rhona Matthews €600 after finding that Morbury Ltd. T/A Top Security’s practice of including public holiday pay in a composite hourly rate was a very serious breach of the Organisation of Working Time Act 1997. The company was also directed to review its contracts and payroll policy. A second complaint was not well founded; the WRC found it was brought outside the time limit and was not well founded, and the merits were not decided.

Matthews said she worked as a security guard and received no additional public holiday benefit. The company said public holiday pay was included in her hourly rate. The decision was dated 3 January 2023.
