A WRC adjudication officer awarded Kieran McGettigan €1,440 for unused annual leave and €792 for unpaid overtime in a decision dated 11 January 2023. McGettigan said he was owed overtime wages and payment for unused annual leave when his employment ended. The respondent, Jayden & Preston Limited trading as Parcel King, said a third-party contractor had not paid it for overtime and that annual leave was pro rata. The officer found the overtime records were undisputed and that correspondence showed the company had agreed to pay overtime. The officer also accepted that McGettigan had six days of outstanding annual leave from 2021 that had not been paid. The decision awarded €792 under the Payment of Wages Act, including €396 for 33 hours of overtime and an additional €396 as reasonable compensation. It awarded €1,440 under the Organisation of Working Time Act, equal to three weeks’ wages, as just and equitable compensation.
