The Workplace Relations Commission found Rehab Enterprises Limited did not unfairly dismiss George Mongey when it made his role redundant, rejecting his complaint that he was unfairly selected. The decision, dated 14 August 2023, concerned his Quality Environmental Safety Officer role, which had nationwide duties.
Mongey argued that his role was not standalone, the selection was predetermined and biased, and the employer should have used a selection matrix. Rehab said it faced sustained financial losses and had redistributed his functions. The adjudicator accepted the redundancy was genuine: Mongey was not replaced, and his duties went to other staff.
The decision also records consultation meetings, union representation and an appeal, and says Mongey did not apply for vacant roles in Navan and Cork. The adjudicator found he had an opportunity to challenge the proposed redundancy and could not conclude that an allegation of advance disclosure proved the decision was predetermined. The complaint was found not well founded.
