The Workplace Relations Commission found three complaints by Timothy Rodriguez against his former employer, Wincanton Ireland Limited, not well founded. The decision was dated 13 February 2023. Rodriguez said he was placed on unpaid suspension despite providing evidence that he could work in Ireland, and that he left because he was not paid. Wincanton said it had concerns about his permission to work, that he was slow to provide clarification and did not return after being invited back. The WRC rejected his constructive dismissal complaint, citing his failure to use the company’s internal grievance process. Constructive dismissal is when an employee resigns because of an employer’s conduct in circumstances where it would be reasonable to leave. It also found no race discrimination, saying Wincanton had tried to clarify his permission to work, and rejected the wage complaint because he had not worked the hours for which he sought payment.
