WRC rejects Letterkenny doctor’s sick-pay complaint against HSE

The Workplace Relations Commission found that Anas Musa had not proved an unlawful deduction of wages after the Health Service Executive Letterkenny University Hospital refused sick pay during periods of certified sick leave. The decision was dated 24 February 2023.

Musa argued that a certificate from a doctor on the specialist register should qualify under the sick-pay policy, and that an Occupational Health recommendation supported his absence during a later period. The HSE said the first certificate was not signed by a practitioner on the General Register and that it had not received a certificate for the later period.

The officer found that the policy required certification by a practitioner on the General Register and that Occupational Health’s recommendation did not replace the required certificate. The complaint was found not well founded.
