The Workplace Relations Commission found former Rbcm Limited chief executive Conor Gilligan was unfairly dismissed and awarded him €126,888 in compensation. The decision was dated 14 December 2023.

Gilligan had worked for RBCM since 1990 and became chief executive in 2003. The company ended his employment on a no-fault basis, giving six months’ notice. RBCM did not attend the hearing or present evidence, although the WRC found it had been notified.

The WRC found that RBCM gave no reason for the dismissal and did not follow fair procedures. It said the company had not shown the dismissal was fair. Gilligan had secured lower-paid work, and the WRC found he had made sufficient efforts to limit his losses. It also found he made no contribution to the decision to dismiss him.

The €126,888 award covers actual, ongoing and future losses. The WRC did not include a requested bonus in the remuneration used to calculate compensation.
