The Workplace Relations Commission awarded delivery driver Henry Connolly €5,000 after finding Freshtoday Wexford Limited penalised him for raising a workplace health-and-safety concern about a PCR test. The decision was dated 14 December 2023.
Connolly said he was dismissed after contracting Covid and raising concerns about the test. The company denied that Covid was the reason and cited performance issues during his probation. The WRC found the company had not documented those concerns for him before his employment ended, and that his representation about the test was related to the termination.
The WRC found Connolly’s discrimination complaint and a separate complaint about penalisation over his terms of employment not well founded. He withdrew three other complaints, under laws covering young workers, parental leave and fixed-term work.
