The Workplace Relations Commission (WRC) found Rona O Neill’s constructive unfair dismissal complaint against Beacon Hospital not well founded in a decision dated 4 January 2023. O Neill said a dispute over the role of a new practitioner strained working relationships. She said a meeting with management and HR left her feeling isolated and that the hospital’s handling of her grievance led her to resign. Beacon Hospital said it was trying to address her concerns and that she resigned before the agreed discussions could be completed. The WRC found the May meeting had been handled poorly, with both sides contributing to how it went. It also found that a process agreed with the hospital’s HR director had barely begun when O Neill resigned. In a constructive dismissal claim, an employee who resigns must generally show that the employer’s conduct justified leaving and that they made reasonable efforts to resolve the grievance first.
