WRC disallows Sky Handling worker’s redundancy appeal

The Workplace Relations Commission disallowed Loredana Mihaela Serbanescu Mituica’s appeal for statutory redundancy pay from Sky Handling Partner Ltd, finding that her post had not been made redundant. The decision was dated 9 December 2022. Mituica said she had been laid off during the pandemic and returned to work in April 2021 on reduced hours. She argued that the company had not provided the minimum hours in her contract. Sky Handling said it had recalled her to work, accommodated her request to work weekends and that her job remained available. The adjudication officer found that the position had been filled by another employee and that Mituica left voluntarily while her contracted hours were available. The appeal was disallowed.
