The WRC found that Edward Slevin And Company T/A Slevins Department Store discriminated against Tara Curran on the disability ground and ordered €5,500 compensation. The decision was dated 27 February 2023.
Curran said she was denied work after telling the employer she had post-natal depression. The respondent denied dismissing her and said it had offered work after a misunderstanding. The adjudication officer found Curran was not offered hours while other employees, including some with shorter service, were rostered, and the respondent did not rebut the evidence that her disability was a factor. The award reflected the impact of discrimination, Curran’s failure to raise her concerns with the employer and the employer’s efforts to resolve the situation. Her separate family-status complaint was withdrawn.
