WRC rejects Gerard Stynes’s redundancy claim against Castle Durrow

The Workplace Relations Commission rejected Gerard Stynes’s redundancy claim against Towerbrook Ltd t/a Castle Durrow, finding that work was available and that redundancy payment was not available in the circumstances. The decision was dated 3 March 2023. Stynes said he had been laid off during the Covid emergency and had not been re-employed. The employer said it had repeatedly tried to contact him after the hotel reopened and that his job was available. The adjudication officer preferred the employer’s registered-mail records and evidence of an offer of work.
